Welcome to Awahhs. These Terms and Conditions ("Terms") govern your access to and use of services provided by Awahhs, a Website Design & Management Company offering hosting plans, custom domain names, and free website design for businesses across Jamaica. By using our website, services, or purchasing a plan, you agree to these Terms.

Definitions

Awahhs means the company providing services described herein.
Client means any person, business, or entity that registers for, purchases, or uses Awahhs services.
Services means website design, website management, hosting plans, domain registration, email hosting, maintenance, and related services offered by Awahhs.
Free Website Design means the promotional website design service offered under specific eligibility and usage rules described below.
Account means the Client’s registered account with Awahhs.
Content means text, images, audio, video, data, and other materials uploaded, posted, or transmitted by the Client through Awahhs services.

Scope of Services

  • Website Design and Setup. Awahhs provides website design services tailored for businesses in Jamaica. Design scope, deliverables, timelines, and revisions are set out in the service order or proposal.
  • Hosting Plans. Awahhs offers managed hosting plans with varying storage, bandwidth, and feature levels. Specific plan features and limits are described on our website and in the Client’s plan confirmation.
  • Domain Names. Awahhs may register, transfer, or manage domain names on behalf of Clients. Domain registration is subject to registrar rules and renewal fees.
  • Management and Maintenance. Ongoing updates, backups, security monitoring, and technical support are provided according to the Client’s chosen plan.

Eligibility and Account Registration

  • Eligibility. Services are available to businesses and individuals legally able to enter contracts in Jamaica. By registering, you represent that you are authorized to act on behalf of the business.
  • Account Information. Clients must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of account credentials and for all activity under your account. Notify Awahhs immediately of any unauthorized use.

Free Website Design Offer

  • Eligibility. Free Website Design is a promotional offer for qualifying Jamaican businesses as described on our website or promotional materials. Eligibility criteria, scope, and duration are determined by Awahhs and may change.
  • Scope and Deliverables. The free design includes a basic business website template, up to a specified number of pages, and one round of revisions unless otherwise stated. Additional pages, custom features, e-commerce, or integrations are billed separately.
  • Hosting Requirement. Free Website Design requires the Client to subscribe to an Awahhs hosting plan for a minimum period as specified in the offer. If the Client cancels hosting before the minimum period ends, Awahhs may charge a pro-rated fee.
  • Ownership and Transfer. Awahhs retains ownership of proprietary templates and code used to deliver the free design. The Client receives a license to use the delivered website content subject to full payment of any applicable fees and compliance with these Terms.

Fees, Billing, and Payment

  • Fees. Fees for hosting, domain registration, premium design, and add-on services are set out on our website or in the Client’s invoice. All fees are payable in the currency specified at purchase.
  • Billing Cycle. Hosting and management services are billed monthly or annually as selected by the Client. Domain renewals and one-time services are billed as applicable.
  • Payment Methods. Awahhs accepts payment methods listed on the website. The Client authorizes recurring charges for subscription services until cancelled.
  • Late Payments. Late or failed payments may result in suspension or termination of services and additional collection costs. Awahhs may place a hold on websites or domains for unpaid invoices.

Refunds and Cancellations

  • Refund Policy. Refund eligibility varies by service. One-time design fees and domain registration fees are generally non-refundable after work has commenced or the domain is registered. Hosting plans may offer a limited trial or refund window as stated at purchase.
  • Cancellation. Clients may cancel subscriptions according to the cancellation terms in their plan. Cancellation does not relieve the Client of outstanding fees incurred prior to cancellation.
  • Domain Transfers. Domain transfers away from Awahhs may be subject to transfer fees and must comply with registrar transfer policies.

Service Levels and Maintenance

  • Availability. Awahhs strives to provide reliable hosting and management services but does not guarantee uninterrupted service. Scheduled maintenance and updates may result in temporary downtime.
  • Backups. Awahhs performs routine backups according to the Client’s plan. Clients are responsible for maintaining their own copies of critical data. Awahhs is not liable for data loss beyond the scope of its backup commitments.
  • Support. Technical support is provided per the Client’s plan. Response times and support channels are described in the plan documentation.

Acceptable Use

  • Prohibited Content. Clients must not use Awahhs services to host or transmit illegal, infringing, defamatory, obscene, or harmful content. Awahhs may remove or disable access to Content that violates these Terms or applicable law.
  • Security. Clients must not attempt to breach, probe, or circumvent Awahhs systems or security. Any security incidents must be reported immediately.
  • Resource Abuse. Excessive use of resources beyond plan limits may result in throttling, additional charges, or required plan upgrades.

Intellectual Property

  • Client Content. Clients retain ownership of Content they upload or provide. By uploading Content, the Client grants Awahhs a non-exclusive license to use, reproduce, and display the Content as necessary to provide services.
  • Awahhs Materials. Awahhs retains ownership of its proprietary code, templates, tools, and documentation. The Client receives a limited, non-transferable license to use delivered website files as specified in the service agreement.
  • Third Party Materials. Use of third-party themes, plugins, fonts, or media may be subject to separate licenses. The Client is responsible for complying with third-party license terms.

Privacy and Data Protection

  • Privacy Policy. Awahhs collects and processes personal data in accordance with its Privacy Policy. By using our services, Clients consent to the collection, use, and storage of data as described in that policy.
  • Data Access. Awahhs may access Client Content as necessary to provide services, perform maintenance, or comply with legal obligations. Awahhs will not disclose Client Content except as required by law or as permitted by the Client.

Warranties and Disclaimers

  • No Implied Warranties. Except where prohibited by law, Awahhs provides services "as is" and disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • Performance. Awahhs does not warrant specific search engine rankings, business results, or uninterrupted access. Performance depends on many factors outside Awahhs control.

Limitation of Liability

  • Cap on Liability. To the fullest extent permitted by law, Awahhs’ total liability for any claim arising from these Terms or the Services will not exceed the total fees paid by the Client to Awahhs in the six months preceding the claim.
  • Exclusion of Damages. Awahhs is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, loss of data, or business interruption.

Indemnification

  • Client Indemnity. The Client agrees to indemnify, defend, and hold harmless Awahhs and its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from the Client’s use of the Services, violation of these Terms, or infringement of third-party rights.

Termination

  • Termination by Awahhs. Awahhs may suspend or terminate services for breach of these Terms, non-payment, illegal activity, or other conduct harmful to Awahhs or its customers.
  • Effect of Termination. Upon termination, Awahhs may delete or archive Client Content after any applicable notice period. Clients should export their data prior to termination. Termination does not relieve the Client of outstanding payment obligations.

Changes to Terms and Services

  • Modifications. Awahhs may modify these Terms, service features, pricing, or policies. Material changes will be posted on our website or communicated to Clients. Continued use after notice constitutes acceptance of the changes.
  • Promotional Offers. Promotional terms, including Free Website Design offers, may be changed or withdrawn at Awahhs’ discretion.

Governing Law and Dispute Resolution

  • Governing Law. These Terms are governed by and construed in accordance with the laws of Jamaica.
  • Dispute Resolution. Parties will attempt to resolve disputes amicably. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts of Jamaica unless otherwise agreed in writing.

Notices and Contact

  • Notices. Awahhs may provide notices by email to the address on file or by posting on the website. Clients must keep contact information current.
  • Contact. For questions about these Terms or Awahhs services, contact us via the contact details on our website.

Miscellaneous

  • Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
  • Entire Agreement. These Terms, together with any service order, proposal, or plan documentation, constitute the entire agreement between the Client and Awahhs regarding the Services.
  • Assignment. Awahhs may assign its rights and obligations under these Terms. Clients may not assign without Awahhs’ prior written consent.
